City of Duarte Lawsuit Against Azusa and Vulcan Advances
The City of Duarte’s lawsuit against Vulcan Materials and the City of Azusa seeking to both overturn the certification of the Final Environment Impact Report (EIR) and Vulcan’s entitlements due to the City Council’s Brown Act violations is moving forward.
Many steps are being taken simultaneously by Duarte’s legal team to keep the process advancing through the court system. Specifically, attorneys for the City are currently awaiting documents from the City of Azusa so Duarte can prepare the “Administrative Record” for the case. The Administrative Record consists of all of the documents that went before the Azusa Planning Commission and City Council on the Vulcan matter when those two entities took their action. Finally, the assigned judge to the case has also scheduled a status conference on the lawsuit for mid-November. At that time, the judge may establish a schedule for Duarte and Azusa to submit legal briefs on the matter. Duarte does not anticipate, however, that there will be an actual court hearing on the case until early 2011.
In its current form, the Vulcan mining expansion project is poised to destroy Van Tassel Ridge as Vulcan plans to extract 105.6 million tons of aggregate from the mountain between now and 2038. Over that same period, the City of Azusa stands to make more than $65 million in mining fees and incentives from Vulcan at the expense of its neighbors in Duarte.
